JAL Mileage Bank ("JMB") is operated by Japan Airlines Co., Ltd. ("JAL").
Any individual who registers as a member ( the "Member") of JMB must understand and acknowledge the terms and conditions set forth in these JMB Rules and Conditions, the JAL JMB websites, and any applicable tariffs and must comply with those terms and conditions. For purposes of these Rules "JAL" shall mean Japan Airlines Co., Ltd., Japan TransOcean Air Co., Ltd., J-AIR Co., Ltd., Japan Air Commuter Co., Ltd., Ryukyu Air Commuter Co., Ltd., and Hokkaido Air System Co., LTD..
(1) APPLICATION
The applicant must correctly fill in all the necessary items on the application form and apply to JMB. The only address the Member can register with the JMB will be either the Member's home address or Member's work address in that country where the Member is presently residing.
(2) QUALIFICATION
Qualification for Membership will be effective at the time of completion of registration on the designated system after the application arrives at JMB.
(3) PROHIBITION OF MULTIPLE MEMBERSHIP REGISTRATION
A Member may have only one JMB membership number. If a Member is found to have multiple JMB membership numbers, JAL will consolidate the multiple JMB memberships into a single JMB membership number. Furthermore, if a Member has accumulated multiple or excess mileage credit as a result of holding multiple JMB memberships, JAL reserves the right to withdraw all excess mileage from the Member's account(s) and adjust the Member's account to reflect the proper mileage amount.
(4) MEMBERSHIP JURISDICTION
The country of the Member's JMB Registered Address will determine the regional JMB program under which a qualifying Member will participate. The services provided may differ according to the particular jurisdiction.
(5) INFANTS
Infants (persons under the age of two (2) years for International travel or age three (3) for Japan Domestic travel) who do not occupy their own seat will be unable to accumulate mileage when traveling. Members who are the parents or legal guardians of infants, on the infant's behalf, will be able to redeem mileage for JMB awards. The amount of mileage deducted for infants who travel on award tickets and who occupy their own seat will be the same amount of mileage as that required for adult-travel awards. The amount of mileage deducted for infants who travel on JAL International Award Tickets and who do not occupy their own seat will be 10% of the amount of mileage that is required for adult-level awards, provided that the accompanying adult travels on the same award type. However, JAL International Upgrade Awards issued for infants will require the same amount of mileage as adults, regardless of whether or not the infant occupies his/her own seat.
(6) CHILDREN
Children (persons age two (2) through eleven (11) years for International travel or age three (3) through eleven (11) for Japan Domestic travel) will accrue the same amount of mileage as adults (persons twelve (12) years and over) except for bonus mileage awarded pursuant to special campaigns or promotions, when specifically stated. The amount of mileage deducted for child-travel awards will be the same amount of mileage as that required for adult-travel awards.
(7) MEMBERSHIP DATA CHANGES・ RESPONSIBILITY OF NOTIFICATION
If information originally submitted by a Member in connection with the Member's JMB application changes, the Member is responsible for notifying JMB of those changes promptly in the designated manner. JAL will not be held responsible for any damages the Member incurs due to non-delivery, omissions or errors etc. of the Member's notification.
(8) TERMINATION OF MEMBERSHIP
If a Member does not accumulate mileage within thirty-six (36) months after becoming a member, or a member's account remains inactive at zero mileage for a consecutive thirty-six (36) month period, JAL may withdraw or cancel the membership of such member.
(This rule does not apply to JALCARD and JAL FAMILY CLUB (“JALFC”) member programs.)
(9) WITHDRAWAL FROM MEMBERSHIP
If a Member wishes to withdraw from JMB, the Member must so notify JMB in writing. Withdrawal will be effective on the day on which JMB registers the withdrawal in the designated registration system. All the mileage accumulated in the Member's account will expire at that time.
(10) SETTING
The Member shall register a password in the designated manner. If JMB finds the password to be inappropriate, JMB may change the registered password in the designated manner.
(11) DUTY OF MANAGEMENT
Members shall manage the password with the duty of care of a good manager to keep it private. Furthermore, the lending or transferring of a member card to others, and the offering of card information to others for their use are not permitted.
(12) CHANGES TO PASSWORD
The Member can change the password and shall be responsible for changing the password regularly. Only the Member may change the password; neither a proxy nor JMB may do so.
(13) VALIDITY OF MILEAGE
Mileage will be valid through the last day (based on Japan time) of the 36th month following the month of transaction. After the expiration date, the mileage in the Member's account will expire. JAL shall not be held liable or responsible for the expiration of the mileage.
(14) COMBINING MILEAGE AMONG MEMBERS
The pooling, combining, or transferring of accrued mileage between Members is not permitted. However, Members who are registered under the same JALFC membership are able to combine accrued mileage only at the time of redeeming mileage for the JMB awards as one of the JALFC membership privileges. If a Member dies, mileage accrued by the Member may be transferred to the Member's heir at law through the designated procedures.
(15) REFUND OF THE MILEAGE
Except for Mileage Reinstatement Service,mileage for unused awards will not be refunded back into the Member's account or the award user's account nor will it be exchanged for other awards. JAL shall not be held liable or responsible for compensating the Member for the unused awards.
(16) PERSONS ELIGIBLE TO USE MILEAGE AWARDS
Awards may be used by only the Member and the following individuals designated by the Member ("Designated Users"):
Member's spouse, Member's parents, Member's grandparents, Member's siblings, Member's siblings' spouses, Member's children, Member's children's spouses, Member's grandchildren, Member's grandchildren's spouses, Member's spouse's parents, Member's spouse's grandparents, Member's spouse's siblings, spouse of Member's brothers and sisters-in-law.
When a Designated User intends to use an award, JAL may request the Designated User to submit official documents verifying his/her relationship with the Member.
(17) CORRECTION OF MILEAGE
If any discrepancy exists between the correct mileage and the registered mileage, JAL reserves the right to adjust the registered mileage to the correct mileage in accordance with the JMB Rules and Conditions regardless of the responsibility for the discrepancy.
(18) MILEAGE CREDIT
(A)JMB flight mileage will be calculated based on the flight sector designated by JAL and JMB partner airlines and the fare of the purchased ticket ("Paid Ticket"), provided that the Member himself/herself travels on a ticket issued in his/her name. The Member should observe these JMB Rules and Conditions and any applicable tariffs. Mileage will not be accumulated if the Member violates or attempts to violate such Rules and tariffs, including the non-transferability of tickets.
In the case of involuntary upgrades, JMB flight mileage will be calculated based on the fare of the Paid Ticket regardless of whether the class of travel differs from the Paid Ticket.
In the case of involuntary downgrades, JMB flight mileage will be based on the actual class of service traveled. A Paid Ticket must be based on Eligible Fares. Award tickets do not qualify as Paid Tickets. If a flight that is eligible for mileage credit does not operate for any reason including, but not limited to, weather, mechanical irregularities, cancellations or delays, and a Member does not or cannot board that flight, mileage will not be credited to such Member's JMB account.
(B)In the event that a Member fails to register for mileage accumulation, or a Member finds a discrepancy in the mileage records, the Member must claim on JMB within six (6) months from the date of boarding.
JMB may request the Member to submit proof of travel, such as the boarding pass with the Member's name and Ticket receipt of the requested sector.
(19) ELIGIBILITY OF BENEFITS
Depending on the particular conditions of program participation, number of accumulated miles, place of residence, or application for certain JMB campaigns, JMB may restrict the number of accumulating miles, awards to be offered, other promotional benefits, and/or information services to certain Members only.
(20) APPLICATION FOR AWARDS
Redemption of mileage awards from JAL must be made only by individuals registered as Members. Even if the person using the award is a "Designated User" (defined in Rule 16), the Member must always be the person to redeem mileage for awards. However, a proxy appointed by the Member in the manner separately designated by JMB and approved by JMB may apply for the awards on behalf of the Member.Mileage may not be redeemed for JMB awards for a maximum of sixty (60) days following enrollment in JMB.
(21) DELIVERY ADDRESS
All awards will be sent to the JMB registered address of the Member requesting the award, even if the award is to be used by a Designated User and/or the proxy redeems the award. If any awards are to be issued in person at a ticket counter in the Member's region of residence, such awards will only be given to a Member or to a specific person stated in a letter of proxy signed by the Member. In either case, the individual can receive the award(s) in person only upon presentation of appropriate identification.
(22) RESTRICTED TRAVEL DATES AND CAPACITY CONTROLS
JAL and JAL's partner companies may control the number of seats made available for award tickets and upgrade awards, and may subject award tickets and upgrade awards to embargo periods to restrict award travel. Therefore, seats for travel awards may not be available for all flights. Embargo dates are subject to change. All award refunds, mileage refunds to the Member's account, or extensions of award validity, etc. are subject to, and may be refused due to, the restricted travel dates and capacity controls above.
(23) CHANGES TO AWARDS
Awards redeemable with mileage may be terminated or changed at any time.
(24) AWARDS WITH EXPIRATION DATE
Awards offered with an expiration date will not be redeemed after the expiration date.
(25) PROHIBITION OF SALE
The selling, bartering, or exchanging of award certificates, award tickets, or any other awards is not permitted. Furthermore, the exchange or attempted exchange of any mileage award tickets, award certificates, JAL coupons, lounge coupons, upgrade coupons, or other awards into cash or items of monetary value, or putting such awards up for auction on auction sites on the internet is not permitted.
(26) DENIAL OF BOARDING ON RESERVED FLIGHTS
If a Member or a Designated User is unable to board a reserved flight or class, in no event will JAL be liable or responsible for any damage or loss to the Member or the Designated User. However, the Member may request a refund of mileage only equal to the portion of the itinerary applicable to the unused flights or classes. If a Member or a Designated User traveling with a Paid Ticket using an upgrade award encounters such situation, compensation will be provided based on the rules for the Paid Tickets.
(27) TRANSFERS TO OTHER AIRLINES
Under no circumstances is JAL obligated to transfer a Member or Designated User traveling on an award ticket to another carrier due to flight delays, cancellations, or any other flight irregularities. JAL will, however, circumstances permitting, attempt to make alternative transportation available on JAL or one of its partner airlines where use of the award ticket is permitted.
(28) TAXES & FEES
The Member or Designated User is solely responsible to bear and pay any taxes, surcharges, fees or other charges including, without limitation, income taxes, customs taxes, departure taxes, airport facility surcharges, and security taxes and fees which may be payable or assessed as a result of the receipt or use of award tickets, upgrade awards or any other JMB benefits or awards. By becoming a JMB Member, the Member agrees to indemnify and hold harmless JAL, its directors, officers, agents and employees from any tax liability on JMB benefits or awards that might be assessed by any relevant tax authorities, including the tax authorities of the Member's or Designated User's country of residence or the country of the Member's or Designated User's employer.
(29) ISSUANCE AND VALIDITY OF AWARDS
(A) JAL will issue international and domestic award tickets on a round-trip basis or a one-way travel basis. If the Member or a Designated User intends to use an award ticket, JAL will deduct the required mileage for round-trip or one-way travel respectively from the Member’s account.
International award tickets and domestic award tickets for travel on JAL will be valid only for the flight and date originally reserved.
(B) Upgrade awards for travel on JAL is valid only for the flight for which reservations and mileage redemption were made. In order to use upgrade awards a Member or a Designated User must have an eligible ticket.
(C) Unless otherwise specified, the validity of award tickets for JMB partner airlines will be one (1) year from the date of commencement of travel. Travel must commence within one (1) year from the date the award ticket is issued.
(30) PARTNER AIRLINES
The pooling, combining, or transferring of accrued mileage to or from JMB to or from other mileage programs, including programs of JAL partner companies, will not be permitted. The use of awards to travel on JAL partner airlines or the use of awards to receive the services of any other JAL partner companies are subject to the rules and conditions established by each respective partner.
(31) CHANGES TO PARTNERSHIPS
JAL reserves the right to change partnership agreements with the partner airlines and other partner companies without prior notice to the Members. Once issued, the awards will be valid for the period stated on each award, regardless of the change of the partnership agreements.
(32) TERMINATION OF PARTNERSHIPS
Notwithstanding Rule 31, JAL reserves the right to terminate partnership agreements with the partner airlines and other companies without prior notice to the Members. Once issued, the awards will be valid for the period stated on each award, regardless of the termination of the partnership agreements. However, this does not apply in the event of sudden business suspension, etc. of partner companies.
(33) EXCLUSION OF LIABILITY
With regard to JMB services used by others due to the Member's willful misconduct or negligence, JAL will in no event be liable or responsible for any damage or loss to the Member.
(34) GOVERNMENT REGULATIONS
The JMB Rules and Conditions are subject to all relevant laws and government regulations.
(35) LOSS OR THEFT
JAL shall not be held liable or responsible for the loss or theft of issued award certificates, award tickets or any other awards. JAL shall also not be held liable or responsible for any accidents, delays, loss, or damages which may result from using postal, air courier or other delivery services to send award certificates, award tickets or other awards to Members. In no event will JAL have any obligation to replace any lost, stolen, damaged or destroyed award certificates, free award tickets or other awards.
(36) NOTICE OF CHANGES
JAL may change or revise these Rules and Conditions with due advance notice of the change(s), the renewed provision(s), and the effective date of the change(s) in an appropriate manner, such as by posting them on the JAL websites.
JAL shall provide three (3) months advance notice to Members (except in the case of a disqualified member), regarding:
(A) termination of mileage accumulation for eligible fares.
(B) changes to mileage accrual percentages for eligible fares.
(C) termination of awards.
(D) changes to award levels.
(E) changes to conditions for requesting awards.
Accumulating mileage, redeeming mileage for awards, or logging in to the JAL website after JAL announces any changes or revisions to the Rules and Conditions will constitute the Member's agreement to the changes or revisions.
(37) LATEST RULES
All rules and conditions set forth in the latest versions of the JAL websites or printed materials will take precedence over all prior JMB Rules and Conditions.
(38) IDENTIFICATION OF A MEMBER
When an application for an award is made and the award is implemented based on the procedures stipulated in the JMB Rules and Conditions, JMB will deal with the application and implementation of the Member's award in an effective manner.
(39) CAUSES FOR MEMBERSHIP DISQUALIFICATION
A: The Member's registration data is at present incorrect.
B: Submission of a false declaration or notice in relation to mileage credit or award usage.
C: Engagement in conduct not permitted under these JMB Rules and Conditions or other rules.
D: Engagement in conduct which JAL judges to harm the Member's mutual trust with JAL.
If a member engages or attempts to engage in any of the above conduct, JAL may immediately terminate membership, withdraw mileage and awards, claim for damages, temporarily suspend JMB member services, and/or deny the member's future participation in JMB. Furthermore, JAL or governmental authorities may take appropriate administrative and/or legal action.
In principle, the total amount of damages to be claimed will be the full amount of actual damages sustained by JAL. However, if a Member engages in the improper use of an award ticket or facilitates the improper use of an award ticket by a third party, the Member who engaged in the misconduct will be subject to the applicable normal passenger fares and associated charges for the sector of improper award ticket use.
(40) ARBITRATION
As part of a Member's enrollment in the JMB, the Member agrees that any dispute, controversy or claim arising out of or relating to this JMB program shall be settled and resolved by arbitration in accordance with the rules and procedures designated for the respective regions where the JMB Member has his/her JMB Registered Address as follows:
For Members with a JMB Registered Address in North America, arbitration will be conducted under the Rules for International Arbitration of the American Arbitration Association (expedited procedures) in the City of Los Angeles or at a location mutually acceptable to the parties which is the domicile or permanent residence of the Member provided that JAL has an office for ticketing Members in that location.
For Members with a JMB Registered Address in Central or South America, arbitration will be conducted under the Rules of Conciliation and Arbitration of the International Chamber of Commerce in the City of Rio de Janeiro or at a location mutually acceptable to the parties which is the domicile or permanent residence of the Members, provided that JAL has an office for ticketing Members in that location.
For Members with a JMB Registered Address in Asia/Oceania (excluding Japan), arbitration will be conducted under the UNCITRAL Model Law on International Commercial Arbitration in the City of Singapore or at a location mutually acceptable to the parties which is the domicile or permanent residence of the Member provided that JAL has an office for ticketing Members in that location.
For Members with a JMB Registered Address in Europe, the Middle East or Africa, arbitration will be conducted under the Rules of the London Court of International Arbitration in the City of London or at a location mutually acceptable to the parties which is the domicile or permanent residence of the Member provided that JAL has an office for ticketing Members in that location.
For Members with a JMB Registered Address in Japan, arbitration will be conducted under the Japan Commercial Arbitration Association (JCAA) in the City of Tokyo or at a location in Japan mutually acceptable to the parties which is the domicile or permanent residence of the Member provided that JAL has an office for ticketing Members in that location.
(41) NOTICE OF JMB TERMINATION
JAL will notify members at least six (6) months prior to the termination of the JMB. Commencing on the date the JMB is to terminate, further mileage accumulation will not be permitted. JAL will provide members with a one (1) year period from the date of JAL's notice of JMB termination to use any miles accumulated prior to the date on which the JMB terminates.
(42) USAGE OF PERSONAL INFORMATION
JAL will handle submitted personal information relating to JMB in accordance with these Rules and Conditions and JAL’s most recent JAL Group Privacy Policy. The JAL Group Privacy Policy can be viewed on the JAL website and other channels.
(43) PROVISION OF INFORMATION TO TRAVEL AGENCIES
When a Member provides his or her JMB membership number to a travel agency, JAL will provide the travel agency with information that is necessary to operate its air travel services such as air transportation, package tours and hotels etc., such as membership number, name, age, gender, telephone number, types of membership cards, FLY ON Program/JGC status, jurisdictional region and necessity of wheelchair arrangements.
(44) PROVISION OF PERSONAL INFORMATION TO PARTNER AIRLINES
JAL shall provide partner airlines with information on FLY ON Program service status members or JAL Global Club members such as JMB membership number, Member's name, gender, and service status so that partner airlines can provide high quality reservation, air transportation and other ancillary services for top tier members.In case the oneworld Management Company (the"oMC"), the central alliance office of the oneworld alliance, of which JAL is a member, conducts a survey questionnaire concerning service enhancements for JMB FLY ON Program service status Members or JAL Global Club members, JAL may provide the oMC with information such as the Member's name, e-mail address, and member service privileges registered with the JMB.
(45) EXCLUSION OF ANTISOCIAL FORCES
The Member represents and warrants that the Member and Designated Users are not an organized crime group, a member of an organized crime group, a person who ceased to be a member of an organized crime group within the past five (5) years, a quasi-member of an organized crime group, a company related or associated to an organized crime group, a corporate racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns or political activities, a crime group specializing in intellectual crimes, or any other person equivalent thereto (“Antisocial Forces”). When JAL judges that a screening is needed for assessment, the Member will cooperate with that screening within reasonable limits. If it is determined that the Member is an Antisocial Force, JAL will immediately terminate membership and cancel award reservations and other awards without prior notice. JAL will not be liable to the Member for any damage incurred by the Member due termination of membership.
